i-9 verification
The Form I-9, issued by the U.S. Citizenship and Immigration Services (USCIS), verifies the identity and employment eligibility for employees hired in the U.S. The form is to be completed by both the employee and the employer (or authorized representative). As part of the process, the employee must present documents verifying his or her eligibility to work in the U.S., and the employer (or authorized representative) must physically examine these documents.
According to the USCIS Handbook for Employers, employers “may designate someone to fill out Forms I-9 for you, such as a personnel officer, foreman, agent, or anyone else acting on your behalf, such as a notary public.”
During the I-9 verification process, notaries act only as authorized representatives (as opposed to in their official capacity) and do not notarize or affix a stamp to the form. The job of the notary in this instance is only to certify that the correct forms have been presented.
As an authorized representative, the notary will examine the employee’s identification documents while in their physical presence, and then complete Section 2 of the I-9 form.
